SD.7    CONSIDER accepting report from the Health Services Director on the U.S. Department of Health and Human Services - Centers for Medicare and Medicaid Services.  (William Walker, M.D., Health Services Director) (All Districts)

ACCEPTED the report from the Health Services Director regarding the Centers for Medicare and Medicaid Services Citations; COMMITTED to assure that all of the Plans of Corrections are implemented in an appropriate timeline; COMMITTED to appropriate ongoing oversight and monitoring of the Hospital and Clinics.

 

By unanimous vote, with all Supervisors present, the following Urgency item was added as SD.7.5 to the agenda and subsequently approved by unanimous vote:

 

U.1      The Board of Supervisors RECEIVED a report on the Richmond Chevron Refinery fire that occurred on Monday, January 15, 2007.  

 

SD.8    HEARING on the adoption of Resolution No. 2007/1 levying an additional assessment of two dollars ($2.00) for every ten dollars ($10.00) or fraction thereof, as permitted by Government Code 76000.5, of every fine, penalty, or forfeiture collected by the Courts for specified criminal offenses, for deposit into the Emergency Medical Services Fund for distribution and use in accordance with Health and Safety Code 1797.98a, and making related California Environmental Quality Act findings.  (Patrick Godley, Health Services Department) (All Districts)

D.3      HEARING on the appeal of the Notice and Order to Abate zoning violations on the real property located at 127 Aspen Drive, Pacheco (MariCare Medical Marijuana Facility - Tenant)(Nettie Pineda & Anita Frias, Property Owners). (Phil Ludolph, Building Inspection Department) (District IV)

 

CLOSED the public hearing and ADOPTED the recommendations of staff as presented today including: ADOPTED the findings in the staff report; AFFIRMED the County Abatement Officer’s determination in the notice and order to abate by finding that the marijuana dispensary located at 127 Aspen Drive, Pacheco is an illegal land use in violation of Contra Costa County Ordinance Nos. 2006-12 and 2006-17, Ordinance Code sections 84.44.402 and 84-44.404, and Ordinance Code section 82-2.006; ORDERED the abatement of the zoning violations (use of property as a marijuana dispensary, removal of all marijuana and all products containing marijuana from the premises, and cease making available marijuana to any person on the premises); DIRECTED the County Abatement Officer to take action to abate the property and charge the cost of  the work and all administrative costs to the property owner if the property owner does not comply with the Board’s order; and DIRECTED the County Abatement Officer to send the Board’s decision to the property owners and each party who appeared at the hearing, and to file the Boards decision with the Clerk of the Board of Supervisors.

 

D.4      CONSIDER accepting a preliminary report from the Employment and Human Services Director on the October 27, 2006 child fatality referral. (Joe Valentine, Employment and Human Services Director) (All Districts)

ACCEPTED a preliminary report from the Employment and Human Services Department (EHSD) Director on the October 27, 2006 child fatality; DIRECTED this matter be referred to the Family and Human Services Committee for ongoing questioning and monitoring; DIRECTED Health Services Department and Alameda-Contra Costa Medical Association to be involved in all discussions related to this matter; and DIRECTED the EHSD Director to meet with various department heads to collaborate and work together through the EHSD System.

C.32    APPROVE and AUTHORIZE the Health Services Director, or designee, to execute a contract with Marci Boone in an amount not to exceed $36,519 to provide employment assistance services for the County’s Mental Health Vocational Services Program for the period November 1, 2006 through October 31, 2007. C.33    APPROVE and AUTHORIZE the Health Services Director, or designee, to execute a contract with Interim Physicians, Inc., in an amount not to exceed $300,000 to provide physician recruitment and temporary help services for Contra Costa Regional Medical Center and Contra Costa Health Centers, for the period January 1 through December 31, 2007. C.34    APPROVE and AUTHORIZE the Health Services Director, or designee, to execute a contract with Staff Care, Inc., in an amount not to exceed $500,000 to provide temporary physician services for Contra Costa Regional Medical Center and Contra Costa Health Centers for the period January 1 through December 31, 2007. C.35    AUTHORIZE the Risk Manager to execute a contract with the Contra Costa County Schools Insurance Group to continue performing medical billing reviews on behalf of the County Risk Management Division for the period January 1, through December 31, 2007. C.36    APPROVE and AUTHORIZE the Community Development Director, or designee, to execute a contract amendment with Candida A. Wensley to increase the payment limit by $72,000 to a new payment limit of  $97,000, and to extend the term from January 31, 2007 to January 31, 2008 for specializing planning services. C.37    APPROVE and AUTHORIZE the Community Development Director, or designee, to execute a contract with the City of Richmond in an amount not to exceed $606,823 to oversee implementation of the 2006/2007 North Richmond Waste and Recovery Mitigation Fee Expenditure Plan, for the period January 16, to December 31, 2007. C.41    CONTINUE the emergency action originally taken by the Board of Supervisors on March 21, 2006, pursuant to Public Contract Code Sections 22035 and 22050, regarding the repair of storm damage to roads and channels as a result of the severe storm that began on December 31, 2005, as recommended by the Public Works Director, Countywide. C.42    ADOPT Resolution No. 2007/23 prepared by the Retirement Administrator, which establishes the retirement plan contribution rates for employers and employees for new Safety Tier C for the period January 1, 2007 through June 30, 2008, as recommended by the County Administrator. C.46    DESIGNATE The Olson Company as the developer of Redevelopment Agency-owned property at 1250 Las Juntas Way, Walnut Creek; and AUTHORIZE the Redevelopment Director to execute an Exclusive Negotiating Rights Agreement with The Olson Company. (No impact on the General Fund) (District IV)

 

 

GENERAL INFORMATION

 

 The Board meets in all its capacities pursuant to Ordinance Code Section 24-2.402, including as the Housing Authority and the Redevelopment Agency.  Persons who wish to address the Board should complete the form provided for that purpose and furnish a copy of any written statement to the Clerk.

 

All matters listed under CONSENT ITEMS are considered by the Board to be routine and will be enacted by one motion. There will be no separate discussion of these items unless requested by a member of the Board or a member of the public prior to the time the Board votes on the motion to adopt.

 

Persons who wish to speak on matters set for PUBLIC HEARINGS will be heard when the Chair calls for comments from those persons who are in support thereof or in opposition thereto.  After persons have spoken, the hearing is closed and the matter is subject to discussion and action by the Board.

Requests for reconsideration of a land use (planning) decision must be submitted in writing to the Clerk of the Board of Supervisors within 10 days of the Board's decision, and must identify the new information which was not before the Board of Supervisors when the decision was made.

 

The County will provide reasonable accommodations for persons with disabilities planning to attend Board meetings who contact the Clerk of the Board at least 24 hours before the meeting, at (925) 335-1900; TDD (925) 335-1915.  An assistive listening device is available from the Clerk, Room 106.
